"No surprise, then, that when Judge Walker correctly barred them from relying on religious rationales, proponents of Prop. 8 could only offer rationales so threadbare that they could not survive even the mildest form of constitutional scrutiny.
The claim that children raised by opposite-sex couples fare better than children raised by same-sex couples has been soundly refuted in the social science literature. The claim that procreation is the purpose of marriage is belied by the fact that infertile people have always been permitted to marry. The claim that marriage has "always been" one way is undercut by the fact that we once used to ban interracial marriage or to consider a wife legally merged into her husband's identity".
